Employers should pay attention to the circumstances under which they wish to dismiss an employee. This is once again proven by a judgment of the district court in Assen. A hospital had to pay its employee (a pharmacist) a transition allowance of € 45,000 and an equitable remuneration of € 125,000 as there were no reasonable grounds for termination of the employment contract. The hospital claimed that the pharmacist was dysfunctional, which turned out not to be the case. The contract, however, was dissolved nonetheless, with the assigned benefits as a result. Reason for this was that in the meantime the employment relationship had become disrupted, which was entirely attributable to the employer.
