Family supervision order

A family supervision order is the child protection measure by which the juvenile court instructs a certified institution to supervise a minor. The parents retain authority but must follow the family guardian’s directions.

Legal basis

Article 1:255 of the Dutch Civil Code sets the test: the child must be growing up in circumstances that seriously threaten its development, the care the parents provide must be inadequate to remove that threat, and it must be expected that the parents can resume responsibility themselves within an acceptable period. The measure lasts a maximum of one year and can be extended. Article 1:265b governs authorisation for out-of-home placement, granted only where necessary in the interests of the child’s care and upbringing or to investigate the parenting situation. Article 1:265f allows the institution temporarily to restrict contact. A written direction can be challenged before the juvenile court under Article 1:264.

How it works in practice

The application almost always comes from the Child Care and Protection Board. At the hearing the parents and, from the age of twelve, the child are heard. Parents who disagree with how the order is being implemented have two routes: challenging a specific written direction, and applying for the measure to be ended or the institution replaced. In urgent cases a provisional order can be made, sometimes without hearing the parents first.

Where it goes wrong

Parents let the period for challenging a direction lapse and only contest matters at the extension stage. A second error is failing to keep their own record of agreements and reports, leaving the institution’s account against theirs. Third, parents underestimate the significance of the acceptable period: the longer the measure lasts, the more heavily it weighs in an application to terminate authority.
